Partners' Terms & Conditions for Hosting myScheme URL on Third-Party Websites
These Terms of Use ("Terms") govern your ("You/Your/Party") hosting and usage of myScheme’s URL on your website. By hosting or using myScheme’s URL ("Platform/We/Us/Our"), You agree to be strictly bound by these Terms and that the Terms control your relationship with us. Read all the Terms carefully. If You do not agree to these Terms, Kindly refrain from hosting or using myScheme’s URL on your website for any purpose. Any deviation from or misuse of these Terms will be considered a breach of these Terms and shall result in immediate termination to host/use the URL on your website.
You may not host the URL and may not accept the Terms if (a) you are not of legal age to form a binding contract with Us, or (b) you are a person barred from using or hosting the URL under any applicable laws. If you are hosting the URL on behalf of an entity, you represent and warrant that you have the authority to bind that entity to the Terms and by accepting the Terms, you are doing so on behalf of that entity (and all references to "You" in the Terms refer to that entity).
To host the URL You may be required to provide certain information (such as identification or contact details) so that You can be informed of any changes or updation therein. Ensure that any information provided to Us by You will always be accurate and up to date and You will inform us promptly of any updates. We shall use submitted information in accordance with the applicable Privacy Policy.
1. Integrity of the myScheme URL
1.1 The myScheme URL must remain in its original form, directing users to the official myScheme portal without modification, shortening, masking, or embedding in any content, including iframes or redirection services.1.2 The URL must always direct users to the official myScheme.gov.in website without any intermediary pages, pop-ups, or content layers.1.3 We do not permit myScheme’s pages to be loaded into frames on Your site. The pages belonging to the myScheme website must load into a newly opened browser window of the User.2. Security Requirements
2.1 The Party must implement robust security protocols, including HTTPS encryption, firewall protections, and regular penetration testing, to protect user data and the integrity of the URL.2.2 The Party must comply with established security standards, including the OWASP Top 10 for web security vulnerabilities.2.3 Any security breach must be reported to the myScheme team within 24 hours, and immediate actions must be taken to mitigate the breach.2.4 Regular security audits, including third-party assessments, must be conducted to ensure ongoing compliance with security standards.3. Positive Representation
3.1 The myScheme URL must be hosted alongside content that accurately reflects myScheme’s purpose and does not mislead users. It must not be hosted on pages containing defamatory, obscene, misleading, or otherwise inappropriate content that violates public policy or community standards.3.2 The myScheme team reserves the right to review the placement of the URL on partner websites.4. Relevant Placement
4.1 The URL must be placed in relevant sections of the third-party website that align with the purpose and services of myScheme, with priority given to visible, user-friendly areas (e.g., above the fold or within a dedicated government services section).4.2 The URL must not be placed in a context that may confuse users about myScheme’s nature or its government affiliation.5. Compliance with Legal and Regulatory Frameworks
5.1 You will comply with all applicable law, regulation, and third party rights (including without limitation laws regarding the import or export of data or software, privacy etc.).5.2 You shall adhere to the prevalent data protection laws and regulations including without limitation the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000, or any Rules or Regulations framed therein, and other relevant prevalent laws/rules/ordinances/notifications/bylaws, etc. at the time of usage while handling the data accessed or obtained by You under these Terms.5.3 You shall not process any data that is governed under any specific law or regulation that requires separate consent or approval without obtaining the said consent or approval from the competent authority.5.4 The Party must ensure that any third-party services or platforms used in relation to hosting the URL are compliant with relevant laws.6. Prohibition of Misuse
6.1 The myScheme URL must not be used in any manner that is deceptive, misleading or unlawful, including but not limited to unlawful redirections, phishing, or other malicious activities. You are prohibited from using the URL must not be used in a manner that misrepresents or diminishes the credibility of myScheme.6.2 The URL shall not be used in commercial advertisements, promotions, or profit-driven activities without prior written consent of myScheme.7. Indemnity
You (as an “Indemnifying Party”), to the maximum extent permitted by law, shall defend, protect, and indemnify Us (as an “Indemnified Party”). The Indemnifying Party shall hold the Indemnified Party and their officers, employees, directors, and consultants, as the case may be (all Third-Party referred to in this clause as 'Indemnified Parties'), harmless from and against any and all proven or alleged losses, demands, damages, liabilities, interest, awards, judgments, settlements, fines, penalties, and compromises relating to any Third Party claims, actions, causes of action, or suits arising out of, due to, or in connection with, directly or indirectly, the performance or non-performance of these Terms or breach of any warranty, representation, or covenant contained herein. The obligation to indemnify shall extend to and encompass all costs and expenses incurred by the Indemnified Party in defending such claims, demands, lawsuits, or actions, including, but not limited to, attorney, witness, and expert witness fees, and any other litigation- related expenses.8. Disclaimer of Warranties
8.1 The APIs are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.8.2 The Party shall be solely responsible for any and all risks associated with hosting the myScheme URL, including but not limited to cybersecurity threats, reputational damage, or legal consequences.8.3 myScheme shall not be liable for any damages, losses, or liabilities arising from the Party's actions or omissions related to hosting the URL. The Party shall be responsible for ensuring compliance with all applicable security protocols, laws, and regulations.9. Termination
9.1 myScheme reserves the right to order immediate removal and You shall be required to immediately remove the URL from Your website if You are found in violation of any of the Terms.9.2 The Party must comply with any such order of removal within forty-eight (48) hours of receiving such communication.10. Support and Resources
myScheme may, at its discretion, provide resources or guidelines to assist the Party in complying with these Terms, including best practices for URL placement, security measures, and content hosting.11. Intellectual Property
a. All the intellectual property rights and interests including without limitation, trade mark, copyright, designs, or patents in the website shall exclusively belong to Us. These Terms in no manner grant You any ownership rights or exclusivity over the website.b. You will not make any statement regarding Your hosting/hyperlinking of the web site that suggests partnership with, sponsorship by, or endorsement by Us without Our prior written approval.c. We allow a hyperlink that only displays Our name or website address. Any use or display of myScheme logos, trade names, and trademarks as a hyperlink will not be allowed.12. Amendment
We reserve the right to modify these Terms at any time, with or without notice. You are requested to periodically review these terms for your continued usage/hosting of myScheme URL.13. Limitation of Liability
In no event shall We be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with your usage/hosting of the myScheme URL, regardless of the cause of action (whether in contract, tort, breach of warranty, or otherwise) and even if We has been advised of the possibility of such damages.14. Severability
If any provision of these Terms is determined to be unenforceable for any reason, then the remaining provisions hereof shall remain unaffected and in full force and effect.15. Governing Law, Jurisdiction and Dispute Resolution
Any complaints, grievances, or concerns regarding the Platform, its content, or its services, shall be first directed to the CTO, NeGD, Digital India Corporation and be mutually resolved through mediation.These Terms shall be governed according to the Indian laws and each Party shall submit to the jurisdiction of the Courts at Delhi, India.Any differences or disputes arising out of these Terms including any question regarding its existence, validity, or termination shall be resolved mutually by the parties through negotiations.In case of non-resolution of disputes as mentioned above, the dispute shall be referred to Arbitration of a Sole Arbitrator mutually appointed by both the parties and in terms of the Arbitration and Conciliation Act, 1996. The place and seat of the arbitration shall be at New Delhi and proceedings shall be conducted in English language. The parties shall resort to litigation as a last resort only if the alternative dispute resolution mechanisms fail to resolve the dispute.
